This section defines Berry Street’s Code of Conduct to ensure a respectful, safe, and ethical environment for all patients and providers.

Berry Street is a platform dedicated to fostering a respectful, safe, and inclusive environment for all users, including patients and providers. By using this Platform, you agree to the following standards of conduct. Violations of these terms may result in corrective action, including suspension or termination of access to the Platform.

1. Respectful Communication

Users are expected to maintain respectful and professional interactions with others at all times. Specifically, users shall not use language, jokes, or statements that:

  • Are defamatory, violent, abusive, or threatening;

  • Reflect bigotry, hate, racism, sexism, or include any jokes or statements offensive to another person based on race, gender, sexual orientation, citizenship status, ethnic origin, religious affiliation, or other personal characteristics;

  • Are vulgar, obscene, or indecent in nature.

2. Privacy and Confidentiality

The privacy and confidentiality of all users are protected under this Code of Conduct. Users shall not:

  • Violate HIPAA or any other privacy regulations regarding health or personal data;

  • Engage in any activity that compromises the privacy or confidentiality of other users on the Platform.

3. Prohibited Content and Behavior

The following content and behaviors are strictly prohibited:

  • Describing, encouraging, or promoting illegal or criminal activities;

  • Violating any privacy or intellectual property rights of individuals or organizations;

  • Engaging in manipulative, intimidating, or exploitative behavior.

4. Inclusivity and Accessibility

The Platform is committed to diversity and inclusivity, striving to create a safe, welcoming, and accessible environment for all users. Users shall refrain from any actions, language, or practices that marginalize, exclude, or disparage any individual or group.

5. Compliance with Platform Standards

  • Patients: Any patient who violates this Code of Conduct, breaches the Late-Cancellation policy more than three times (as outlined in the Terms of Use), or requires more than five provider rematches may be subject to account termination.

  • Providers: Any provider who violates this Code of Conduct or accumulates more than three missed or late-canceled appointments may face suspension or permanent removal from the Platform.

6. Compliance with Professional Code of Ethics

All Providers are required to uphold and adhere to the highest standards of professionalism as outlined in our Code of Ethics for the Nutrition and Dietetics Profession. This includes maintaining integrity, honesty, and accountability in all interactions and decisions, ensuring respectful and equitable treatment of all clients, and prioritizing the well-being and health of those we serve.

7. Right to Suspend or Terminate Access

The Platform reserves the right to suspend or terminate access for any user at its discretion, including the right to terminate without cause. This right is exercised in order to uphold a safe, positive, and supportive environment on the Platform.
